www.eatfromitaly.com is a website of wine&food goods for sale on-line according to the Italian norm on distance contracts.

The sale is regulated by the present General Conditions as well as the methods pinpointed on the site, in the parts where the rules on goods order and delivery and privacy are shown.

DEFINITIONS

The term “user” points out (and from now on we will identify him with this name) the subject that enters the website exclusively to view the contents. The term “customer” points out (and from now on we will identify him with this name) the subject that, besides entering the website, drives a commercial transaction sending the order of eatfromitaly product/s.

The distance-selling service offered by eatfromitaly is available only for the customers, meant as the physical and legal subjects that act with purposes irrelevant to the trade, entrepreneurial or professional business that they carry out.

ACCEPTANCE OF THE GENERAL CONDITIONS

All services and goods are offered to the user by eatfromitaly, brand of SPS srl, whose headquarter and references are indicated above.

According to the present General Conditions of contract, SPS srl reserves the right to modify at any moment and without notice the General Conditions of the service; changes about which the customer will be informed  through the proper communications on eatfromitaly website ( and, at SPS srl’s discretion, even by email, if known); changes that will have efficacy only at the moment of publication. Therefore, the changes will be effective only for the transactions driven after their publication. Moreover, eatfromitaly will offer services regulated by different General Conditions; in such case they will be communicated to the customer when he accedes to the services.

CONCLUSION OF THE CONTRACT

The order sent by the customer to SPS srl must be fully completed and must contain all the elements required for the correct identification of the client, of the ordered products and of their place of delivery; the incompleteness of these data makes it invalid and impossible to be fulfilled.

SPS srl will send the client an email to confirm the order’s reception expressly referring to the present General Conditions of the service.

SERVICE DESCRIPTION

The website provides commercial and general information on the products for sale and, more in general, information and news about the wine&food world.

All the products’ images and photos are very detailed but purely representative. The site’s users aren’t allowed to use and/or publish images and photos reproduced on eatfromitaly for purposes different from those provided for by the present General Conditions. The site’s surfing and content-view service is completely free.

FEATURES AND AVAILABILITY OF THE PRODUCTS

SPS srl, in case of particular events, will not be able to guarantee the availability of the offered products, thus it shall not be considered responsible to the temporary unavailability of one or more products. In this case, except for the right of withdrawal, the customer’s order-sending is equivalent to the acceptance even of a partial delivery limited to the available products among those ordered. Moreover, it is equivalent to the renunciation to require a refund and/or a compensation for the partial delivery.

Normally, except for exceptions, on the website there are all the products deliverable in 48 hours (present in SPS srl warehouses at the moment of the order) and the products deliverable in 7 days (or differently specified on the single product). For the products deliverable in 7 days we carry out the order at the moment of your purchase; this may – besides causing delays during the 7 days if our supplier delays the delivery – not guarantee the complete correspondence of the product to the features mentioned on the website (for example the wine’s year may not be the same in case of the supplier’s depletion of that year). SPS srl will refund, upon their return, the amount of the products with changed features on the customer’s request.

INDEMNITY CLAUSE

The consumer declares and pledges to indemnify and hold harmless SPS srl from any claim for damages, including legal expenses, that may come from the use of the service, from the consumer’s connection to the service, as well as from a violation of the norms that regulate its use.

SPS srl reserves the right to modify or deactivate, temporarily or permanently, the service (or any part of it) with or without communicating it to the user and to the customer. The user and the customer agree that SPS srl shall not be considered responsible towards them or others for probable changes of service, that is for a suspension or a deactivation.

COMMUNICATIONS

The communications to the non-customer user will be transmitted by publication on the website. All the communications to the customer will be transmitted by email.
